General Terms and Conditions
Article 1 - General
1.1 Definitions: In these terms and conditions the following terms shall have the following meanings:
* Supplementary agreement: an agreement whereby you acquire products and/or services in connection with a distance contract, provided by the entrepreneur or a third party.
* Reflection period: the period within which you can make use of your right of withdrawal.
* Consumer: the natural person who is not acting for business purposes.
* Day: calendar day.
* Durable medium: any instrument which enables you to store information addressed personally to you for future reference.
* Right of withdrawal: your option to cancel the distance contract within the cooling-off period.
* Model withdrawal form: the European model withdrawal form, which is made available by the entrepreneur.
* Entrepreneur: Slow Fashion Vintage, the natural or legal person who offers products to consumers.
* Distance contract: an agreement between the entrepreneur and you, concluded within the framework of an organised system for distance selling (e.g. via a webshop).
* Distance communication technology: means that can be used to conclude an agreement without you and the entrepreneur having to be in the same room at the same time.

1.3 Applicability:
1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to you. If this is not reasonably possible, the entrepreneur will indicate how the general terms and conditions can be viewed and that they will be sent to you free of charge as soon as possible upon your request.
3. If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to you electronically, so that it can be easily stored on a durable data carrier.
Article 2 - The Offer and the Agreement
2.1 The offer:
1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated.
2. The offer contains a complete and accurate description of the products offered (with emphasis on their vintage and used character ). If the entrepreneur uses images, these are a true representation of the products offered.
3. Obvious errors or mistakes in the offer do not bind the entrepreneur.
2.2 The Agreement:
1. The agreement is concluded at the moment you accept the offer and meet the conditions set.
2. If you have accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance of the offer electronically.
3. The entrepreneur shall take appropriate technical and organizational measures to secure the electronic transfer of data and shall ensure a secure web environment.
Article 3 - Your Right of Withdrawal (Return Policy)
3.1 Reflection period: You can cancel an agreement regarding the purchase of a product during a reflection period of 14 days without giving reasons. This reflection period starts on the day after you, or a third party designated by you, has received the product.
3.2 Your obligations during the cooling-off period:
1. During the cooling-off period, you will handle the product and packaging with care. You will only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product.
2. You are liable for any diminished value of the product resulting from handling other than what is permitted.
3.3 Exercise of the right of withdrawal and costs:
1. If you make use of your right of withdrawal, you must report this to the entrepreneur within the cooling-off period using the model withdrawal form provided by us or in another unambiguous manner.
2. You return the product as soon as possible, but no later than 14 days from the day of cancellation.
3. The costs of returning the product are for the account of the consumer, unless the entrepreneur has indicated otherwise prior to the purchase that he will bear these costs.
3.4 Our obligations in case of revocation:
1. The entrepreneur will reimburse all payments from you, including any standard delivery costs for the outward shipment, without delay but no later than 14 days after the day on which you report the withdrawal. Unless the entrepreneur collects the product himself, he may wait with reimbursement until he has received the product or you prove that the product has been returned.
2. The entrepreneur will use the same payment method for reimbursement as you used for the original transaction.
3.5 Exclusion of the right of withdrawal:
The nature of the products offered by Slow Fashion Vintage (used vintage clothing) does not in principle prevent the right of withdrawal. The entrepreneur can exclude products and services from the right of withdrawal only if:
1. Products which are manufactured to the consumer's specifications and which are not prefabricated and which are manufactured on the basis of an individual choice or decision by the consumer or which are clearly intended for a specific person;
2. Sealed products which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Article 4 - Price and Payment
4.1 The price:
1. During the period of validity stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
2. The prices stated in the offer of products or services include VAT.
4.2 Payment:
1. Unless otherwise specified in the agreement, the amounts owed by you must be paid within 14 days after the start of the cooling-off period.
2. If you do not meet your payment obligation on time, the entrepreneur is entitled to charge the extrajudicial collection costs incurred by him.
Article 5 - Delivery, Execution and Conformity
5.1 Delivery and execution:
1. The entrepreneur will take the greatest possible care when executing orders for products.
2. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to you.
5.2 Product quality and conformity:
1. Our items are in used vintage condition unless otherwise stated. The specific condition of each item is accurately described on the product page and is also visible on the detailed product photos.
2. All photos presented on the webshop are detailed to show you the product in its true condition, fit and color.
3. The entrepreneur guarantees that the delivered products meet the agreement and the reasonable requirements of soundness and/or usability that you may expect from a used vintage article of the described condition and price . The age and original nature of the product are taken into account.
4. Additional warranty may not go beyond the legal obligations of the entrepreneur.
5. If the product you received is different from the one you ordered in our webshop, please contact us directly via Instagram DM or info@slowfashionvintage.com.
Article 6 - Complaints procedure
Complaints about the performance of the agreement must be submitted to the entrepreneur within a reasonable time (maximum 7 days after you have discovered the defect), fully and clearly described, after you have discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within the period of 14 days with a confirmation of receipt and an indication of when you can expect a more detailed answer.
Article 7 - Disputes and Additional Provisions
7.1 Disputes:
1. Agreements between the entrepreneur and the consumer are exclusively governed by Dutch law.
2. Disputes between you and the entrepreneur regarding the conclusion or performance of agreements can, subject to the provisions below, be submitted by both you and the entrepreneur to the competent court in the Netherlands.
7.2 Additional or deviating provisions:
Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or stored in an accessible manner.
